1. ELIGIBILITY a. The “Razer BlizzCon Sweepstakes” Contest (the “Contest”) is open to all legal residents of the 50 United States, Canada only . b. Contestant must be of a legal age in the aforesaid country of registration. c. The participant to the Contest (the “Contestant”) is required to correctly answer quest questions and submit an entry on (the “Site”) to enter the Contest. d. Each Contestant may only submit a maximum of one (1) entry. Multiple entries are not allowed from any Contestant. Razer is entitled to request and the Contestant shall provide upon such request information for identity verification. e. Employees of Razer USA Ltd (“Razer”), its affiliates and related entities, and such employees’ immediate family members, are not eligible to participate in the Contest. f. No Purchase is necessary. A purchase will not increase your chances of winning. g. Razer reserves the absolute right to disqualify any entry or Contestant in contravention of these eligibility requirements and its decision in this matter will be final, conclusive and binding. 2. TIMING a. Registration Period for the Contests begins on July 16, 2009 (the “Start Date”) and ends on August 3rd, 2009 (the “Stop Date”). b. Administrator's computer is the official time keeping device for the Contest. 3. THE WINNERS a. After the Stop Date, Razer will collate the eligible entries and from the eligible entries, Razer will select at random from successful Contestants ten (10) winners of a Razer Quest prize (“Quest Prize”) for each Quest. b. From Contestants who have successfully completed Quest 01 and Quest 02, one Grand Prize winner shall be selected at random. The selection of the Quest Prize and Grand Prize winners will occur at Razer’s office within thirty (30) days after the Stop Date. c. There will only be twenty (20) Quest Prize Winners (ten (10) winners per Quest) and one (1) Grand Prize winner of the Contest overall. However, Razer reserves the right to select reserve winner(s) (“Reserve Winner”) to substitute any Winners who may be subsequently found to be disqualified or uncontactable. Razer’s selection of the Winner and/or reserve Winners shall be final, conclusive and binding. d. No Contestant shall receive more than one (1) Prize (whether a Quest Prize or Grand Prize) in all from the Contest. e. Winner will be notified by email that he has been selected as the Winner of the Contest. The Winner will also be announced at http://www.razerzone.com. f. If any of the Winners fails to contact Razer within five (5) days of the Winner being notified by email by Razer, Razer reserves the right to substitute a Reserve Winner in place of any of the Winners. Razer will use its best efforts to contact the Winner within sixty (60) days after the Stop Date. 4. PRIZE a. 10 (Ten) Winner will each receive one (1) Razer DeathAdder Gaming Mouse . b. One (1) Grand Prize winner will receive one of the following (at his election): (i) a trip for two (2) to BlizzCon 2009 including economy class airfare, hotel and $300 spending money (in the form of a prepaid Visa card); or (ii) One (1) Razer Prize package, which consists of one (1) Razer Death Adder Gaming Mouse (MSRP $59.99), one (1) Razer Carcharias Headset (MRSP $79.99), and one (1) Razer Lycosa Keyboard (MSRP 79.99) and $500 spending money. The election of the Grand Prize winner shall be final c. All Contestants who complete and provide a valid email address will receive a email coupon for Free Shipping from Razerzone.com d. Ten (10) Ten “Quest One” winners will receive a Razer Quest Prize, which consists of (1) One Razer Gear Messenger Bag (MSRP $79.99) and (1) One 17” RazerGear Laptop Sleeve e. Ten (10) “Quest Two” winners will receive a Razer Quest Prize, which consists of (1) One Razer Death Adder Gaming Mouse. (MSRP $59.99) f. Prizes must be accepted as awarded on an “as-is-where-is” basis and Razer shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the Prize. The Prize cannot be transferred or assigned. Prizes are non-exchangeable, and winner is not entitled to any substitution or cash equivalent. g. Razer reserves the right, in its sole and absolute discretion, to substitute a Prize with another of equivalent kind or approximate value in the event of the unavailability of any Prize or component of the prize for any reason whatsoever. h. Taxes, if any, on prizes are the sole responsibility of the prize winner. Prior to the delivery of any Prize, Razer reserves the right to collect from the winner any taxes it deems appropriate. i. In the event that a Prize is mailed to the winners, the winner assumes the risk of the prize’s safe arrival. j. Winner may be required to provide proof of age and photo identification before any Prize will be awarded. The only accepted types of photo identification are government issued photo identifications, including a valid driver’s license or passport. Razer reserves the right to deny awarding the Prize if the winner fails to provide satisfactory identification, as determined in Razer’s sole discretion. k. In addition, winner may be required to execute a declaration of eligibility, indemnification and release of liability before any Prize is awarded. Failure to execute any of these documents or comply with any of the terms will result in forfeiture of any Prizes. l. Any additional costs relating to the Prizes (apart from shipping and handling), and incurred as a result of accepting the Prizes, is the sole responsibility of the winner. m. Where a Grand Prize Winner elects to undertake the Trip to BlizzCon 2009, no subsequent circumstance shall entitle the Contestant (or his personal representative or estate) to a substitution of the Grand Prize. In particular , he shall be responsible for ensuring that he is permitted under all applicable laws and regulations to travel to the venue of BlizzCon 2009. n. Razer shall not be responsible or liable for any inability to use the Grand Prize arising for any reason whatsoever. However, in the event BlizzCon 2009 is cancelled, Razer shall consider (but is not obliged to allow) appropriate substitution of the Grand Prize. o. Unless otherwise specified as being borne by Razer, all costs associated with travel to BlizzCon 2009 shall remain the responsibility of the Grand Prize Winner. 5. GENERAL TERMS a. Entries must be submitted via the Site, and must be completed and received on or by the Stop Date of the contest. Entries received by telephone, fax, postal mail, courier or personal delivery will not be accepted. b. Entries that are late, incomplete, illegible, damaged, irregular or do not conform to or satisfy any condition herein may be disqualified. c. By entering the contest, the Contestant accepts and agrees to abide by these terms and allows Razer to add them to our email database. d. Razer shall not be responsible for lost, misdirected or delayed entries. e. By entering the contest, the Contestant automatically grants Razer the right to record, publicize and/or use the Contestant’s name, character, photograph, likeness and voice for promotional purposes, without further obligation or compensation to the Contestant. f. As a condition of entry, all Contest entries become the sole property of Razer. By entering the contest, the entry submitted by the Contestant shall belong absolutely to Razer and may be used by Razer for any purpose whatsoever, without further obligation or compensation to the Contestant. All entries shall be retained by Razer and cannot be returned to the Contestant, for any reason. g. Razer, its affiliates and related entities, their officers, directors, agents, shareholders, insurers, and employees, assume no responsibility or liability whatsoever for damages, loss or injury resulting from the Contestant participating in any contest, attending any related events, and/or accepting or using any prize awarded. Razer shall not be liable for any typographical, administrative, production or distribution errors that may occur in the execution of any Contest or in any Contest material. h. All personal information collected in connection with the Contest will be subject to Razer’s Privacy Policy available at Razer’s website www.razerzone.com provided that the Contestant will be deemed by entering the Contest as agreeing to receive any promotional materials, circulars or emails on products from Razer. i. Razer reserves the right to vary, withdraw or terminate the Contest at any time without prior notice and without the need to furnish reason, if in its sole discretion, it determines that the Contest is not capable of being run as originally planned. j. Razer, in its sole discretion, further reserves the right to disqualify any person for (i) violating any of these terms, (ii) tampering with the entry process or the operation of the Razer website, (iii) gaining an unfair advantage in participating in the contest, (iv) obtaining winner status using fraudulent means, or (v) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior. k. IN THE EVENT OF ANY ATTEMPT BY AN CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THE CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST, RAZER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. l. Razer reserves the right in its sole discretion to supplement or make changes to these terms at any time without prior notice. m. Razer reserves the right in its sole discretion to interpret these terms and to determine compliance with these terms, and such interpretation and determination shall be final, conclusive and binding upon all Contestants. No correspondence or claims will be entertained by Razer. n. Decisions of Razer shall be final in all cases. o. The terms herein in no way supersedes or replaces the general Terms and Conditions found at www.razerzone.com but instead ought to be read in conjunction with them. If a specific term is in conflict with or inconsistent to a general term, the specific term shall prevail. General Release. By entering the Contest, you COVENANT NOT TO SUE, FULLY RELEASE AND FOREVER DISCHARGE Razer USA Ltd, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, to the extent permitted by law. |
